- Transparency to deployers and instructions for use (Article 13).
- Human oversight by design — the AI cannot make solely automated employment decisions (Article 14).

GDPR Article 22 — solely automated decisions
EU AI Act high-risk obligations sit on top of GDPR Article 22. Solely automated decisions producing legal or similarly significant effect on a data subject — which clearly includes hiring, promotion, work allocation, and termination — are prohibited unless one of three exceptions applies (contractual necessity, explicit consent, or authorisation by EU or member-state law) and even then suitable safeguards including meaningful human review must be in place. In practice this means that an HR AI tool can score and recommend, but the decision must rest with a human reviewer with real authority to override.
Vendors approach this differently. Greenhouse and Lattice position their AI as decision-assist, not decision-making, which maps well to Article 22. Workday, SuccessFactors, and Eightfold provide rich scoring and ranking — and require careful human-oversight design at deployment. Microsoft Viva Insights uses aggregation thresholds to protect individuals but is politically sensitive in works-council jurisdictions regardless of the technical design.

When NOT to Deploy AI in HR (Four Candor Situations)
